LICENSE
This TEMPLATE LICENCE TERMS AND CONDITIONS OF USE AGREEMENT
("Agreement") is an agreement between AllBoy Productions, Inc. ("Company") and the party set forth in the related order form ("Customer" or "you") incorporated herein by this reference (together with any subsequent order forms submitted by Customer, the "Order") and applies to the purchase of all services ordered by Customer on the Order (collectively, the "Services") and all products ordered by the Customer on the Order (collectively, the "Products"). The parties understand, acknowledge and agree that this is an online agreement which is being entered into in conjunction with the Order. Both parties understand, acknowledge and agree that the Company will grant the Customer non-exclusive limited license to use the web templates sold through our website www.allboyproductions.com (collectively, the "website") in accordance with this Agreement.
1) LIMITED USAGE GRANTED
You may use each individual product on a single website only, belonging to either you or your client. You have to purchase the same template once more in order to make another project with the same design.
2) IMAGERY, CLIPARTS AND FONTS
All imagery, clipart and fonts used in our templates are royalty-free and are the integral part of our products. Limited-usage License gives you the right to use images, clipart and fonts only as a part of the website you build using your template. You can use imagery, clipart and fonts to develop one project only. Any kind of separate usage or distribution is prohibited.
3) MODIFICATIONS
You are authorized to make any necessary modification(s) to our products to fit your purposes.
4) INSTALLATIONS
We do not install any of our products which require this (osCommerce templates, Zen Cart templates, etc.). Installation is a paid service which is not included in the package price.
5) UNAUTHORIZED USE
You may not place any of our products, modified or unmodified, on a diskette, CD, website or any other medium and offer them for redistribution or resale of any kind without prior written consent from our company.
6) ASSIGNABILITY
You may not sub-license, assign, or transfer this license to anyone else without prior written consent from All Boy Productions,Inc.
7) OWNERSHIP
You may not claim intellectual or exclusive ownership to any of our products, modified or unmodified. All products are property of All Boy Productions,Inc. Our products are provided "as is" without warranty of any kind, either expressed or implied. In no event shall our juridical person be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use our products.
8) INFORMATION DISCLOSURE
You may not disclose any order information which includes but is not limited to Order ID, download link, etc.
9) OUR REFUND POLICY
Because of the nature of electronic downloaded products and files delivered via email, there is nothing to return. We do not provide money back on any of our downloaded products, or product files delivered via email. Please make sure that you've carefully read the 'Frequently Asked Questions' section before purchase as it describes the level of experience needed to edit our templates. If you prefer to have our company edit your template for you, we would be happy to do so. Please visit our Custom Design section of the site for rate information and details.
10) THIRD-PARTIES SERVICES
All Boy Productions, Inc. may use third parties to provide certain services accessible through the Web Site. All Boy Productions, Inc. does not control those third parties or their services, and you agree that our company will not be liable to you in any way for your use of such services. These third parties may have their own terms of use and other policies. You must comply with such terms and policies as well as these TOS when you use these services. If any such terms or policies conflict with All Boy Productions, Inc's TOS, agreements or policies, you must comply with All Boy Productions, Inc's TOS, agreements or policies, as applicable.
11) PAYPAL PURCHASES
We reserve the right to request proof of identity from any PayPal member. Furthermore, all New Unverified PayPal members will be required to provide proof of identity. Proof of identity may be provided in the form of scanned copies of a driver's license and one other supporting document, such as a utility bill or telephone bill. Please note: If you are unable to provide this documentation, please do not process your order via your online PayPal member account. Instead, you should choose to pay by credit card thus bypassing the PayPal member sign-in section and enter the required credit card information as instructed. PayPal will still be the payment processing agent for your transaction. However payment authorization will be received directly from the credit card company. Once you have become a verified PayPal member, please feel free to use your membership information for future purchases. Your purchase of our product(s) via PayPal implies that you have read and accepted these terms and conditions.
We reserve the right to delay the delivering of the product if the echeck was used as a payment method. Only after the echeck is cleared the product will be delivered to customer's email.
You understand that our company reserves the right to change or modify these terms with no prior notice.
